Re-Certified Franchise Executive

The International Franchise Association, the world’s oldest and largest franchising organization, has designated Scott as a Certified Franchise Executive (“CFE”). Scott first earned the CFE designation in 2009 and was re-certified in 2012. This is a business-related designation and relatively few lawyers hold this qualification. CFE’s are trained in the areas of franchise management, system expansion methods, and marketing. As part of the CFE program, Scott earned a Certificate in Franchise Management from Georgetown University.

When not stamping out legal fires, Scott puts out the real thing as a volunteer member of the Hawai’i County Fire Department.

This is your attorney hard at work serving the public (actually, it’s a break during training). Prior to moving to Hawai’i, Scott was a volunteer Emergency Medical Technician with the Fairfax County (Virginia) Fire Department. That of course led to countless lawyer jokes about ambulance chasing.

 

Selected to Revise & Update Hawai’i Law Section of Legal Treatise

Kailua Kona, Hawaii

Scott has been selected to revise and update the section on Hawai’i law for the Third Edition of the American Bar Association Forum on Franchising publication entitled Covenants Against Competition in Franchise Agreements. The book analyzes statutory and case law pertaining to “non-compete agreements” on a state-by-state basis.

Franchise agreements generally contain provisions which prevent franchisees from competing against the franchised system while conducting business as a franchisee and for a period of time after the termination of the franchise relationship. Court enforcement of these provisions varies widely among the states due to differences in both the statutes and in the underlying public policy.

Vice-Chairman of California State Bar Franchise Law Committee

Scott begins his third year as a member of the California State Bar’s Franchise Law Committee. This Committee is limited to twenty-one franchise law practitioners and meets on a monthly basis to discuss new cases and other developments in franchise law, to propose franchise law statutes and regulations, and to interact with the California Department of Corporations on topics of mutual interest. Scott has been named as the Committee’s Vice Chairman (Programs) for the 2011-2012 term.

Certified as Specialist in Franchise & Distribution Law

San Francisco, California

The State Bar of California Board of Legal Specialization has designated Scott as a Certified Legal Specialist in Franchise & Distribution Law. Scott is among a small and select group of California attorneys who have passed a written test and met stringent requirements pertaining to franchise and distribution law experience, professional education, and peer recommendations. California is the only state which certifies lawyers as specialists in this field of law.
